Chronik eines angekündigten Todes: Trajektorien und Logiken am Lebensende im Schweizer Justizvollzug

Abstract

Zusammenfassung Natürliche Todesfälle in Anstalten des Justizvollzugs nehmen nicht nur weltweit, sondern auch in der Schweiz zu. Auch wenn sich Vorstellungen eines guten Todes von Gefangenen mit jenen von Menschen in Freiheit decken, so stellen sich im Vollzug doch spezifische Herausforderungen und Einschränkungen. Der Artikel analysiert diese mit Referenz auf die institutionellen Logiken welche in den Vollzug eingeschrieben sind. Vor diesem Hintergrund werden verschiedene exemplarische Sterbetrajektorien aufgezeigt, welche die Stationen von Gefangenen am Lebensende verdeutlichen. Insbesondere verwahrten Gefangenen ist der Zugang zu Institutionen mit palliativer Pflege weitestgehend verwehrt. Unter diesem Gesichtspunkt gewinnen Überlegungen zu einem eigenständigen Verwahrungsvollzug auch im Zusammenhang mit dem Lebensende an Bedeutung. Résumé Le nombre de cas de mort naturelle dans les institutions pénitentiaires augmente non seulement au niveau mondial, mais aussi en Suisse. Même si la conception d’une belle mort est la même pour un détenu que pour une personne en liberté, il y a néanmoins des défis et limitations particuliers dans le contexte de l’exécution de sanctions. Cet article analyse ces derniers dans la perspective de la logique institutionnelle inhérente à l’exécution. Sur cette toile de fond, il présente les différentes trajectoires de mort exemplaires qui mettent en évidence les différentes stations de détenus en fin de vie. En particulier, les détenus internés n’ont en principe pas accès à des institutions de soins palliatifs. Dans le contexte de la fin de la vie, une exécution autonome de la détention devient plus importante. Summary The number of natural deaths in prisons increases not only worldwide, but in Switzerland as well. Even though the concept of a good death is the same among prisoners as among people in freedom, there are specific challenges and limitations in the context of the execution of sentences. The following article analyzes these focusing on the institutional logic inherent to execution. Against this background, it describes several exemplary death trajectories that show different stations of prisoners at the end of their life. Access to palliative care institutions is regularly denied to inmates subject to internment. In this context, reflections on the autonomous execution of internments become increasingly important.
